Construing leases is often a matter of law. A jury will rarely resort to the parole evidence rule. Parties should NOT rely on courts to construe better bargains than those the lease provides. When addressing rent in a lease, parties should carefully spell out the proper sum of the rent. Rent provisions should include the exact date rent is due.
Many of the lease agreements (especially, many of the ones created through diy (do it yourself) (do it yourself) auto generating software or bare-bone store sold templates) did not account nor foresaw the catastrophic type of damages, that would inflict both landlords and tenants at the post Covid 19 pandemic era.
This author firmly believes that a lease provision describing the premises should be as detailed as possible to avoid potential mistakes, misunderstandings, and disputes. In certain exceptions, landlords seeking to ??? rents of 5 ??? or more may enforce certain tenant notification requirements.
